TERMS OF SERVICE

THIRD PARTY SOFTWARE.
Customer understands that Daveworks Inc. is responsible for installing and updating certain 3rd party CMS software. The CMS applications have been authored separately by 3rd party application developers that have no proprietary or other interest in Daveworks Inc. Customer understands and accepts that Daveworks Inc. or its subcontractors are not liable for any delays, interruption or termination of service that may occur as a result of failures or operational difficulties on the part any 3rd party applications installed on their website releases Daveworks Inc. and its subcontractors entirely and unconditionally for any inconvenience, damages, or liability as a result of any action, inaction, error, commission or omission of any 3rd party applications.

INDEPENDENT CONTRACTOR.
Daveworks Inc. is providing software maintenance services as an independent contractor. Customer understands and accepts that Daveworks Inc. is not a partner, employee or co-venturer in any manner, form or fashion whatsoever.

Daveworks Inc. and its subcontractors make no warranties or representations of any kind, whether express or implied, for the services being offered. Daveworks Inc. and its subcontractors explicitly disclaims any warranty of merchantability, fitness for a specific purpose or any other warranty or guarantee for the services provided by the Web Hosting Company or and / or 3rd party applications. Daveworks Inc. and its subcontractors are not responsible for any loss or damage as a result of using Daveworks Inc.’s services including but not limited to inconvenience, loss or damage resulting from delays, improper or incomplete delivery of information, possible computer viruses, malware (or similar) or interruption of services.
