Daveworks Inc. does not sell this proprietary code; we provide access to its high-performance results via a subscription model.<\/p>\n<\/section>\n<section>\n<h3 style=\"margin-top: 30px; text-transform: uppercase; font-size: 1.1rem; letter-spacing: 1px;\">2. Licensing &amp; Subscription Model<\/h3>\n<p>Our service operates on a <strong>Subscription\/License<\/strong> basis, similar to cellular phone or web hosting service plans. Access to the Landing Pages is contingent upon an active monthly subscription.<\/p>\n<ul style=\"margin-bottom: 1.5rem;\">\n<li style=\"margin-bottom: 0.5rem;\"><strong>Setup Fee:<\/strong> The one-time setup fee covers the labor of coding the client\u2019s brand &#8220;look and feel&#8221; into our proprietary framework. This fee does not constitute a purchase of the underlying code.<\/li>\n<li style=\"margin-bottom: 0.5rem;\"><strong>Monthly License:<\/strong> The per-page or per-location monthly fee grants the client a revocable license to host and benefit from our proprietary files on their server(s).<\/li>\n<\/ul>\n<\/section>\n<section>\n<h3 style=\"margin-top: 30px; text-transform: uppercase; font-size: 1.1rem; letter-spacing: 1px;\">3. Prohibited Actions &amp; Anti-Piracy<\/h3>\n<p>To maintain the competitive advantage and security of our ecosystem, the following actions are strictly prohibited and constitute a violation of federal copyright law:<\/p>\n<ul style=\"margin-bottom: 1.5rem;\">\n<li style=\"margin-bottom: 0.5rem;\"><strong>Unauthorized Reproduction:<\/strong> Any form of copying, duplicating, or &#8220;mirroring&#8221; the source code, directory structures, or proprietary logic files.<\/li>\n<li style=\"margin-bottom: 0.5rem;\"><strong>Creation of Derivative Works:<\/strong> Using Daveworks Landing Pages as a template or &#8220;base&#8221; to create new pages or systems not managed by Daveworks Inc.<\/li>\n<li style=\"margin-bottom: 0.5rem;\"><strong>Reverse Engineering:<\/strong> Any attempt to deconstruct or &#8220;clone&#8221; the proprietary architectural logic or &#8220;Traffic Controller&#8221; mapping systems.<\/li>\n<li style=\"margin-bottom: 0.5rem;\"><strong>Third-Party Distribution:<\/strong> Transferring, selling, or providing Daveworks proprietary files to third-party developers, agencies, or entities without express written consent.<\/li>\n<li style=\"margin-bottom: 0.5rem;\"><strong>Header Removal:<\/strong> Modification or removal of proprietary ownership headers and license data from .php, .inc, or .js files.<\/li>\n<\/ul>\n<\/section>\n<section>\n<h3 style=\"margin-top: 30px; text-transform: uppercase; font-size: 1.1rem; letter-spacing: 1px;\">4. Cancellation &amp; File Removal<\/h3>\n<p>As there is no long-term commitment, clients may cancel their subscription at any time. However, upon cancellation of the monthly service:<\/p>\n<ul style=\"margin-bottom: 1.5rem;\">\n<li style=\"margin-bottom: 0.5rem;\">The license to use the proprietary Daveworks Landing Pages is immediately revoked.<\/li>\n<li style=\"margin-bottom: 0.5rem;\">Daveworks Inc. will promptly remove all proprietary files from the webhost\u2019s server(s).<\/li>\n<li style=\"margin-bottom: 0.5rem;\">Once files are removed, the pages will no longer be active and will subsequently be removed from the Google search index.<\/li>\n<\/ul>\n<\/section>\n<section>\n<h3 style=\"margin-top: 30px; text-transform: uppercase; font-size: 1.1rem; letter-spacing: 1px;\">5. Breach of IP Rights<\/h3>\n<p>Continued use of Daveworks Inc. proprietary files following a cancellation or a failure to maintain an active subscription constitutes a <strong>Breach of Contract<\/strong> and <strong>Theft of Intellectual Property<\/strong>.
